4.0 Federal Acquisition Regulations - FARs

Shubnum assists in complying with the following FARs:
 
4.1

FAR’s regarding Strategic Plan

FAR 7.105 Contents of written acquisition Plans:
(b) Plan of Action; (2) Competition; (4) Acquisition considerations (ii) (1) “…agency can accomplish its mission more efficiently and effectively…”

Shubnum’s products and services meet the requirements of the applicable FAR 7.105 (b) (2) (4) (ii) (1) to assist an agency meet its mission more efficiently and effectively.

4.2 FAR’s regarding Substantial Benefits

FAR 7.107 Additional Requirements for acquisitions involving bundling:
(a) “Bundling may provide substantial benefits to the Government. However…market research …”
(d) “Measurably substantial benefits may include, …”
(d) “Reduction of administrative or personnel costs alone is not sufficient…unless…”
(e) “Substantial bundling is …”
(f) “ … justify bundling in acquisition strategy documentation.”

Shubnum’s products and services meet the requirements of the applicable FAR 7.107(a) (b) (d) (e) and (f) noted above as well as the added benefit of increased participation by small business, women owned business, disabled veterans business noted by the FAR’s below. Shubnum’s innovations assist in accomplishing both objectives simultaneously.

4.3 FAR’s regarding socioeconomic agenda

FAR 19.201 General policy

“(a) It is the policy of the Government to provide maximum practicable opportunities in its acquisitions to small business, veteran-owned small business, service-disabled veteran-owned small business, HUB Zone small business, small disadvantaged business, and women-owned small business concerns.”

FAR 19.202-1 Encouraging small business participation in acquisitions

“ Small business concerns shall be afforded an equitable opportunity to compete for all contracts that they can perform to the extent consistent with the Government's interest.”
Shubnum’s services and products provide increased participation for the small businesses, veteran-owned small businesses, service-disabled veteran-owned small businesses, HUB Zone small businesses, small disadvantaged businesses, and women-owned small business concerns.
 

4.4 FAR’s regarding Value Engineering

Shubnum provides Value Management™ products and services as contemplated by the FAR are above.
These management products and services may be applied to the Construction-Architect-Engineer industry. However this activity does not in any way purports to provide such “construction-architect-engineer services as contemplated by the Brooks Act and covered by FAR Part 36.”

 
4.5 FAR’s regarding Best Value

FAR 1.102 Statement of guiding principles for the Federal Acquisition System
“ (a) The vision for the Federal Acquisition System is to deliver on a timely basis the best value product or service to the customer, while maintaining the public's trust and fulfilling public policy objectives.”

FAR 37.602-3 Performance Based Contracting
“ Agencies shall use competitive negotiations when appropriate to ensure selection of services that offer the best value to the Government, cost and other factors considered (see 15.304).”

FAR 2.101 Definitions
“ Best value" means the expected outcome of an acquisition that, in the Government's estimation, provides the greatest overall benefit in response to the requirement.

Shubnum provides ‘Best Value’ to a customer in the context of the FAR’s noted above. Such Best Value is based on meeting the letter and intent of the laws, OMB Circulars, FAR’s, Presidential Agendas and the GAO yellow book.
